These Terms of Service govern your use of Barbercita products and services. By accessing or using Barbercita, you agree to these Terms.

Barbercita is owned and operated by Barbercita Co LLC, a New York limited liability company based in Cayuga County, New York.

Who These Terms Apply To

• Barbers and shop owners using Barbercita tools and subscriptions.
• Clients using Client App or web booking experiences powered by Barbercita.
• Affiliates and partners participating in Barbercita referral or partner programs.

Account Eligibility and Responsibility

• You must provide accurate account information and keep it updated.
• You are responsible for activity under your account and for maintaining login security.
• You may not share credentials in a way that bypasses plan limits or platform safeguards.

Service Scope

Barbercita provides booking, client communication, business operations, payment tooling integrations, and related features for Barbers and shops. Features may be added, modified, or discontinued over time.

Billing, Renewals, and Refunds

• Paid plans are billed in advance on recurring billing cycles unless otherwise stated in writing.
• You authorize Barbercita and its payment processors to charge applicable fees, taxes, and authorized add-ons.
• Unless required by law or expressly stated otherwise, fees are non-refundable after a billing period begins.
• If payment fails, we may retry charges, limit account access, or suspend paid features until balances are resolved.

Payment Processing and Financial Data

Payment processing services are provided by third-party processors such as Stripe. Card-on-file and bank account credentials are handled by those processors under their terms and security standards. Barbercita does not store full card numbers or full bank account credentials on Barbercita servers.

Shop Pricing and Surcharge Controls

Where supported, shops may configure pricing and surcharge settings. You are solely responsible for ensuring your pricing, surcharge, and consumer disclosures comply with applicable laws, card-network rules, and local/state requirements.

Acceptable Use

You agree not to misuse the service. Prohibited conduct includes fraud, unauthorized account access, scraping, spam, unlawful marketing, infringement, harassment, malware distribution, and attempts to bypass security or billing controls.

Affiliate and Partner Program Terms

Affiliate/partner participation is subject to additional program rules, including eligibility, attribution, payout timing, reversals for refunds/chargebacks/fraud, and program modifications or termination. Barbercita may withhold or reverse commissions tied to abuse, invalid referrals, or policy violations.

Content, Intellectual Property, and License

• Barbercita retains ownership of the Barbercita platform, software, branding, and related intellectual property.
• You retain ownership of your business content (such as logos, images, and text) that you submit.
• You grant Barbercita a limited license to host, display, and process submitted content as needed to operate services and, where permission exists, promote your shop relationship with Barbercita.

Privacy and Marketing Consent

Use of personal information is governed by the Privacy Policy. Where consent is provided (including during signup), names and photos may be used for marketing in accordance with that policy.

Disclaimers

Barbercita is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Barbercita disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Barbercita Co LLC and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data. Aggregate liability for claims arising from the service will not exceed the amount paid by you to Barbercita in the 12 months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Barbercita Co LLC and its affiliates from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service, your content, your business operations, or your violation of these Terms or applicable law.

Termination

You may stop using the service at any time. Barbercita may suspend or terminate access for non-payment, legal risk, abuse, fraud, security concerns, or violations of these Terms. Provisions that by nature should survive termination will survive, including payment obligations, IP protections, limitations of liability, and indemnification.

Governing Law and Venue

These Terms are governed by New York law, without regard to conflict-of-law principles. Where legally permitted, disputes shall be brought in courts serving Cayuga County, New York, unless another forum is required by applicable law or contract.

Changes to These Terms

We may update these Terms from time to time. Updated terms become effective when posted unless a later effective date is stated. Continued use of the service after updates means you accept the revised Terms.
